Terms of Service
These terms govern the contract between you (as a business owner) and 2taps.
§ 1 Scope
These terms apply to all contracts for the use of the 2taps platform at 2taps.de. Conflicting terms are not accepted unless we agree in writing.
2taps is offered only to entrepreneurs within the meaning of § 14 of the German Civil Code (BGB). Consumers (§ 13 BGB) cannot open a business account.
§ 2 Services
2taps provides a SaaS platform that lets business owners:
- issue digital loyalty cards into Apple Wallet and Google Wallet,
- configure loyalty programs (stamp cards or tiered points),
- let staff scan QR codes to award stamps or points,
- manage their customer list and view stats,
- run a public signup page at
2taps.de/c/<name>.
The exact feature set depends on the selected plan.
§ 3 Formation of Contract
The contract is formed by registering a business account at 2taps.de/register and confirming your email address. Registration on the Free plan is free of charge and open-ended.
§ 4 Plans and Pricing
The prices published at 2taps.de/#pricing at the time of booking apply. All prices are in EUR plus statutory VAT where applicable.
- Free — 0 €/month, reduced feature set, open-ended.
- Starter / Pro / Business — billed monthly via Stripe, cancellable any time.
Billing is monthly in advance. Payment data is stored exclusively at Stripe; 2taps stores only the Stripe reference and the subscription status.
§ 5 Term and Cancellation
Paid plans run monthly and renew automatically by one month unless cancelled before period end. Cancellation is done in the Billing section of the account or by email to hello@2taps.de. On cancellation the paid period remains usable; pro-rata refunds are not granted.
The right to extraordinary termination for cause remains unaffected.
§ 6 User Obligations
- Provide truthful information at registration.
- Keep credentials confidential.
- Do not use 2taps for unlawful content or spam.
- Comply with GDPR when collecting your own customer data and obtain the necessary consents.
- Notify us immediately of any security incident.
§ 7 Data Processing
Where 2taps processes personal data of your customers on your behalf, 2taps acts as a processor under Art. 28 GDPR. A DPA is available on request; see also Privacy Policy § 9.
§ 8 Availability
We aim for 99.5 % availability on an annual average, excluding planned maintenance. A binding SLA is offered only on the Business plan; details on request.
§ 9 Liability
We are liable without limitation for intent, gross negligence, and for personal injury. For simple negligence we are liable only for breach of material contractual obligations (cardinal obligations), limited to the typically foreseeable damage. Liability for lost profits and indirect damages is excluded in cases of simple negligence.
§ 10 Data Backup
You are obligated to keep your own backups (export function available in your profile). We maintain daily backups but do not guarantee successful recovery.
§ 11 Changes to Terms
We reserve the right to amend these terms with reasonable notice (at least 30 days), notified via email. If you do not object within the notice period, the new terms apply. In case of objection we may terminate the contract effective at the end of the current billing period.
§ 12 Final Provisions
German law applies; the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Place of jurisdiction is the seat of 2taps, provided you are a merchant, legal person under public law, or special fund under public law.
Should any provision be invalid, the validity of the remaining provisions remains unaffected.
